Our Terms and Conditions

Version 2.2

Acceptance of our Terms and Conditions

By paying the required deposit you are accepting the Roaring 30s Automobiles ‘Terms and Conditions’. Roaring 30s Automobiles will not accept any hire without the hirer agreeing to these terms and conditions.

Deposit

Roaring 30s requires payment of the deposit published on our website or payment of the full hire price to confirm a booking.

Provisional bookings, where offered by Roaring 30s Automobiles, are valid without deposit for a period of 5 days after which time you must either pay a deposit to confirm the booking or contact us to agree an extension.  After 5 days a provisional booking will lapse and the date will be available to other customers.

By paying the required deposit, you will secure the wedding car and driver for the date and price agreed between the hirer and Roaring 30s Automobiles.
Balance of Payment

The balance must be paid in full 12 weeks before the date of the wedding. Payment may be made by direct bank transfer to the Roaring Thirties bank account (details will be provided when required), by cheque or cash. Roaring 30s are not able to accept credit card payments except via Paypal when any associated charges must be paid by the customer. If you choose to pay by Paypal, we will send a Paypal invoice that will have the Paypal charge added to the total.

If you fail to pay the final balance, you will forfeit the deposit and the contract for hire between the hirer and Roaring 30s Automobiles will be deemed to be cancelled.

Any extension of the payment period must be agreed in writing with Roaring 30s Automobiles before the balance becomes due.

The Price

Roaring 30s prices are published at https://www.roaring30.co.uk/prices-a-payment.

Our published prices are for guidance and must be confirmed at the time of booking.

Our price is always the price at the time of booking and not the price at the time of the wedding.

Our price is all-inclusive – we do not have ‘hidden extras’.

Hire Period

The hire period commences at the arrival at the point of the first collection and ceases on delivery to the reception unless otherwise agreed.
Drivers Time

The drivers’ time is the total time that a driver is away from his point of departure (Looe). The drivers’ time cannot exceed 10 hours.

No Smoking

We operate a strictly No Smoking policy in our cars.

Changes

You are welcome to request changes to your hire at any time prior to the commencement of the hire period. It will be at our discretion if we can agree to these changes.

We will endeavor to accommodate changes requested during the hire period.

We do not charge for changes except where it involves additional cars or drivers.

3rd Party Hire

If you have agreed with us to use the services of a 3rd party as part of the hire, you must refer to the Terms and Conditions of the 3rd party which will be extant.

Cancellation

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you are contracting with us as a consumer, online, by phone, at a wedding fair or any other venue other than our office you have the right to cancel your contract at any time up to 14 calendar days after the day on which you ordered our services. Should you wish to cancel your order you must do so by email to: pat.hicks@roaring30.co.uk by letter to: Roaring 30s Automobiles, Rosehill, Kellow, Looe PL13 1LE. Otherwise, cancellation of a confirmed booking will result in forfeiture of your deposit.

If you cancel your booking within 12 weeks of the hire date then 50% of the hire charge is payable.

If you cancel your booking within 6 weeks of the hire date then 100% of the hire charge is payable.

Roaring 30s recommends that you consider cancellation insurance to cover the charges above. However, Roaring 30s does not offer such insurance.

Cancellation of a confirmed booking must be made in writing to Roaring 30s Automobiles and is effective on the date received by us.

Refusal to Carry

The driver has the right to refuse entry to the vehicle under his control to any person who is, or appears to be under the influence of alcohol or illegal substances.

Any offensive, abusive or intimidating behavior directed at the driver and/or the vehicle in their charge by the hirer or ANY member of the hirers party or guests will result in the termination of hire.

A claim or compensation will not be accepted under these conditions and our decision will is final.

Personal Belongings

Roaring 30s Automobiles will make every effort to ensure that there is no damage or loss to the hirer’s property.

It is the hirer`s responsibility to ensure that all personal items are removed from the vehicle at the end of the hire period.

If we find any Item left in our vehicle by the hirer, we will notify the hirer and hold the item at Roaring 30s Automobiles for 1 month from the date of hire. It will be the responsibility of the hirer to collect such items.

Valuables left in the vehicle are the responsibility of the passenger.

It is the responsibility of the hirer to ensure that members of their party keep their person and clothing clear of any part of the vehicle.

We take no responsibility for personal belongings or clothing that may become dirty, damaged or lost.

Seating

Seat belts are provided in our cars.

We may carry children but they must be under the supervision of an appropriate adult.

Where, because of the age of the child, a special seat belt or seat is required, it is the responsibility of the hirer to fit and remove such devices.

The driver and Roaring 30s Automobiles will not be responsible for the fitting of such a device. The time taken to fit special devices must be taken into account by the hirer.

The hirer is not to make or attempt to make any modification to the vehicle.

The driver can refuse to allow any fitment that he considers dangerous or that might damage the vehicle.

Cars must will not carry more than the driver deems fit or exceed the vehicles specifications.

No animals are allowed, with the exception of guide dogs (must be approved at the time of booking).

Access

The hirer should ensure that adequate access, turnaround and exit for the vehicle(s) is available at all address`s to be attended.

If any point the driver feels that this is restricted in any way then the driver will stop at the nearest legal safe point available, regardless of distance.

The driver has the right to refuse to travel on any surface that he feels may cause damage to the vehicle.

If you have an unmade road or uneven road surface then please inform us at the time of booking.

Collection

The driver will announce that the wedding transport has arrived to the hirer at the address given on the booking form.

Once the driver has announced his arrival, responsibility for keeping to the times in the ‘Transport Plan’ rests with the hirer.

If the party is being collected from a hotel, it is advisable to make themselves available at the agreed time.

The driver will make his presence known to the hotel reception staff and provide them with details of who to be collected.

Delays & Breakdowns

Where the driver considers that an event may present a danger to the passengers or vehicle, he will stop and may abandon the journey.

Roaring 30s Automobiles will endeavor to inform the hirer of any delay arising from either a vehicle breakdown or delays beyond our control.

Whilst we make every effort to keep our vehicles in good order unforeseen events can arise. If the car you have booked develops a fault that cannot be rectified in a timely manner a second vehicle will be dispatched as a replacement.

If the value of the replacement vehicle is less than the hired vehicle the difference will be refunded, if the value of the replacement is greater then there will be no extra charge added.

It is the hirer’s decision whether to accept a replacement.

If this option is not accepted by the hirer then a full refund will be issued and our liability will be no further.

In an emergency, we may attempt to provide alternative transport from 3rd party companies but where we do, the 3rd party’s terms and conditions are extant.

Whilst every effort is taken in finding the best routes for your journey circumstances beyond our control may arise. Road-works, local events, rural activities, road closures, accidents and weather conditions can effect journey times.

Any delays en-route to any location is beyond our control.

No liability can be accepted for any of the above.

Adverse Weather Conditions

We will make every effort to uphold our responsibilities and to make your day run smoothly. However, British weather is very unpredictable. In the event of adverse weather we will decide if it is safe to operate our vehicles.

Should we feel the need to feel that it would be hazardous to operate in the given conditions the hirer will be notified and a full refund issued with no further liability.

We will always observe safe operating practices and safety shall not be compromised. During the winter months it may be advisable to have a back up plan should inclement weather be forecast.

Damage to vehicle

If any member of the hirer’s party causes damage/theft to Roaring 30s Automobiles property, or incites others to cause damage/theft to the vehicle or contents, the hirer will be responsible and liable for all repair/restore costs to the vehicle.

Damage/theft to either the exterior or interior are both the responsibility of the hirer.

Total repair cost will include the cost of repair, loss of bookings and any other incurred costs.

Cleaning

Roaring 30s Automobiles vehicles will arrive in a clean and presentable condition.

Should a person be taken unwell in the car a cleaning charge will be levied.

Should any of the above mentioned items be used in a manner that causes excess cleaning the hirer will be liable for any costs in making good, loss of booking and any other incurred costs.

Complimentary Gifts

These are offered to the Bride and Groom and are given as a courtesy and do not form any part of the hire agreement.

Limitation of Liability

Roaring 30s Automobiles are not responsible for delays or cancellations of ceremonies or receptions, missed appointments or delays, traffic congestion, poor weather conditions, incorrectly advised timings, incomplete address details or other circumstances beyond our control.

Terms and Conditions

We reserve the right to amend our Terms and Conditions at any time. Existing confirmed hirers will be notified of any changes.

At www.roaring30.co.uk, the privacy of our visitors is of extreme importance to us. This privacy policy document outlines the types of personal information is received and collected by www.roaring30.co.uk and how it is used.

Personal Data

Roaring 30s Automobiles will never share your personal data with a third party.

Roaring 30s Automobiles only keeps your personal data so that it can maintain your account for the duration of your booking and to ensure that passengers are collected and delivered as a customer requires.

In order to help plan the wedding day, Roaring 30s Automobiles holds and uses customer personal data.  Roaring 30s deletes all personal data at the end of the calendar year in which each wedding occurs.  If any subject person requires their data removed from Roaring 30s records before that time and notifies us, we will endeavour to remove it within 7 days of receiving a request to do so.

Customers are reminded of this use of personal data on the Roaring 30s Transport Plan and informed that by confirming acceptance of that plan they accept this privacy policy.

OUR DATA PROTECTION STATEMENT
Your personal data is safe with us, we do not collect email addresses forwarding them to third parties, that would be illegal.

Your personal data will be retained for a period not exceeding twelve months following the date of your wedding, at which time it will be deleted. If you require us to delete it at some other point in time please email paul.hicks@roaring30.co.uk with your request. The exception being the documentation that HMRC requires us to keep for a minimum of six years following our annual tax return. That documentation will be encrypted and password protected following our tax return and only re-opened at the request of HMRC. Once the six years has expired all information will then be destroyed. Other than us no other party will have access to any of your data with the exception of our accountants who will be able to access only that which they need to complete our annual tax return to HMRC.

Log Files
Like many other Web sites, www.roaring30.co.uk makes use of log files. The information inside the log files includes internet protocol ( IP ) addresses, type of browser, Internet Service Provider ( ISP ), date/time stamp, referring/exit pages, and number of clicks to analyze trends, administer the site, track user?s movement around the site, and gather demographic information. IP addresses, and other such information are not linked to any information that is personally identifiable.

Cookies and Web Beacons
www.roaring30.co.uk does use cookies to store information about visitors preferences, record user-specific information on which pages the user access or visit, customize Web page content based on visitors browser type or other information that the visitor sends via their browser.

COVID Policy

COVID Safety Rules and Guidelines for Passengers and Drivers

During the current COVID pandemic, Roaring 30s Automobiles have implemented the following policy to help protect passengers and drivers:

  • Our cars may be fitted with a protective screen between the driver and rear seat passengers.
  • If a passenger occupies the front seats in our cars they MUST wear a face mask. 
  • Where possible, increased ventilation will be provided to the passenger compartment with the removal of roof or side panels.
  • Hand sanitiser and hand wipes are provided for passenger and driver use.
  • Drivers will wear a protective facemask when a passenger is carried in the front seat.  The driver will wear gloves when in close proximity to the passengers.
  • The driver will maintain social distancing.
  • Passengers are to wear facemasks when the car is fully enclosed and when a safety screen is not fitted.
  • The driver has the authority to refuse to carry passengers who display any sign symptom associated with COVID.
  • The driver will sanitize the passenger compartment between each change of passengers.
